Apple Inc. registered with the United States Copyright Office to designate an agent for service of process for claims with the Copyright Claims Board (“CCB”). PLEASE NOTE THAT CCB PROCEEDINGS ARE VOLUNTARY FOR ALL PARTIES. APPLE IS EXERCISING ITS RIGHT TO OPT-OUT OF PARTICIPATION IN ALL CCB PROCEEDINGS. Participation in CCB proceedings is optional because it requires the waiver of both the right to have a case heard by a court and the right to a jury trial. Apple chooses to retain the option to exercise its constitutional right to have copyright disputes heard in a federal court with the right to a trial by jury. THE CCB WILL DISMISS CLAIMS WITHOUT PREJUDICE AFTER APPLE OPTS-OUT OF PROCEEDINGS.
If you still wish to file a copyright claim against Apple with the CCB, you must first submit a completed claim form to the CCB and receive a notification from the CCB to proceed with service of the claim.
After receiving a notification from the CCB to proceed with service of the claim, you may submit to Apple’s designated agent for service of CCB claims (the “CCB Service Agent”) the following documents via the below CCB complaint web form: (1) the initial notice prepared by the CCB based on your claim form, (2) a copy of your claim, (3) the opt-out notification form, and (4) any other documents required by the CCB to be included with the notice and claim. Please consult your legal counsel or see Part 222 of Title 37 of the Code of Federal Regulations to confirm these requirements.
Apple has not consented to receive service by email so any CCB claims submitted by email to Apple will be invalid. To reach our CCB Service Agent, you may send or deliver the proper and complete documents via one of the alternate methods listed below:
- by certified, priority, or regular mail to the below address; or
- in-person at Apple’s headquarters located at One Apple Park Way, MS:39-1IPL, Cupertino, CA 95014. Please be sure to indicate that the envelope should be forwarded to the CCB Service Agent at our Mail Stop (MS:39-1IPL) so the receptionist can direct your claim to the correct office.
